These Terms of Service ("Terms") are a binding agreement between you and Kardiacs LLC ("Kardiacs," "we," "us") governing your use of the Kardiacs mobile applications, companion watch apps, the Kardiacs websites (kardiacs.com and the signed-in dashboard at app.kardiacs.com), and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Kardiacs lets you control compatible smart bike trainers over Bluetooth, follow structured workouts, record indoor and outdoor activities (including GPS-tracked rides and runs), plan and navigate outdoor routes with turn-by-turn guidance, import and discover routes, sync activities and daily health metrics with your device's health platform, connect third-party services such as Strava and Spotify, receive push notifications, and receive software-generated suggestions such as workout playlists and readiness insights. Features may change, be added, or be removed at any time.
A signed-in web dashboard at app.kardiacs.com gives you a second way into the same account: your profile, equipment, activity history and routes, and a route builder that imports GPX files and plans rides and runs in your browser. It is a client of the same service, not a separate product, and these Terms apply to it as they do to the apps.
The Service is free to use and supported by advertising: banner advertisements served by Google AdMob in the apps, and advertising served by Google AdSense on the signed-in dashboard, both described in our Privacy Policy. There is nothing to buy — the Service has no paid tier, no subscription, and no in-app purchases.
You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to use the Service. You must provide your date of birth during onboarding; the Service does not activate for anyone under 16. On devices that support it, we also ask Apple for the age range declared on your Apple Account and use it to check the date of birth you gave us. We receive a range (such as "16–17"), never a date of birth, and where the two disagree we apply the lower age. Declining to share the range does not prevent you from using the Service.
Some features require you to be 18 or older: creating an account, and structured workouts — our workout library, the workout builder, and following a structured workout in a session. Users aged 16 or 17 may use the rest of the Service, including activity recording, route planning and navigation, and their activity history, under an anonymous identity. If we determine that an account belongs to someone under 18, we will sign that account out; the account and the data stored under it are retained, and you may sign in again once you turn 18.
An account is optional. The Service works under an anonymous identity created for your install; signing in with Apple or Google adds backup and cross-device sync, and merges your anonymous data into the account (see our Privacy Policy). If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, and you must provide accurate information and keep it current. We may suspend or terminate identities or accounts that violate these Terms.
Exercise involves inherent risk, including the risk of serious injury, cardiac events, and death. The Service controls the resistance of connected trainer equipment and suggests workout intensities. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Consult a physician before beginning any exercise program, particularly if you have a heart condition, are pregnant, or have other health concerns. Stop exercising immediately if you feel pain, dizziness, or shortness of breath. To the maximum extent permitted by applicable law, you voluntarily assume all risks associated with your use of the Service and connected equipment.
Trainer control. During structured workouts the Service can change your trainer's resistance automatically and without further input from you (for example in ERG mode), including sudden increases at interval boundaries. You are responsible for securely mounting your bike on the trainer, maintaining your equipment per the manufacturer's instructions, ensuring adequate clearance and ventilation, and keeping children and pets away from moving equipment. If resistance behaves unexpectedly, stop pedaling; you can pause the workout, disable trainer control, or power off the trainer at any time.
No guaranteed results. Fitness outcomes vary by individual. We make no promises about performance improvements, weight loss, or other training results from using the Service.
Health metrics displayed in the Service (including heart rate, heart-rate variability, blood oxygen, respiratory rate, VO₂max estimates, and readiness or recovery indicators) are estimates for fitness purposes only and must not be relied on for medical decisions. You use workout targets, trainer resistance control, and route suggestions at your own risk and are solely responsible for exercising within your own limits and for the safe setup and operation of your equipment.
For outdoor activities, see also Section 4 (Navigation, Route Guidance, and Local Laws).
Limits of navigation. Route planning, maps, elevation data, and turn-by-turn guidance are aids to help you plan and follow a course — they are not a substitute for your own judgment and observation. Map and routing data may be inaccurate, incomplete, or outdated: roads and paths may be closed, altered, under construction, private, unpaved, or otherwise different from what the map shows, and surface, gradient, and traffic conditions may make a route unsuitable for your ability, equipment, or the current weather and light. GPS positioning can be degraded or unavailable (for example in tunnels, dense tree cover, or urban canyons), and guidance may be delayed, rerouted, or lost if your device loses signal, battery, or connectivity. The Service does not verify that any suggested route is safe, open, or lawful for your mode of travel, and navigation features are not designed for emergency use.
Your responsibility to follow local laws. You are solely responsible for complying with all laws, regulations, and rules that apply where you ride or run, including traffic laws and signals, rules governing which roads, lanes, paths, and trails are open to cyclists or pedestrians, e-bike classifications and restrictions, helmet and lighting requirements, laws restricting headphone or mobile-device use while riding, and posted signage, closures, and access restrictions (including private property and protected areas). Where guidance conflicts with the law, signage, or conditions on the ground, the law and the real world control — disregard the guidance. Remain aware of your surroundings at all times and never interact with the app's screen while moving. You are solely responsible for your safety and for choosing where and how you ride or run.
You retain ownership of the content you create or upload — workouts, routes, activity recordings, and similar data ("User Content"). You grant Kardiacs a worldwide, non-exclusive, royalty-free license to host, store, process, and display User Content as needed to operate and improve the Service. If you contribute routes to shared route discovery features, you additionally grant us the right to make that route geometry available to other users in de-identified form. You are responsible for your User Content and must have the rights to anything you upload.
Content from other users. Routes, workouts, and other content contributed by other users are not created, reviewed, verified, or endorsed by Kardiacs. A shared route is a record of where someone else chose to go — not a representation that it is safe, open, lawful, or suitable for you (see Section 4). You use content from other users at your own risk, and we may remove any User Content at our discretion.
You agree not to: misuse, probe, or disrupt the Service or its infrastructure; attempt to access another user's data; reverse engineer the Service except where the law permits; use the Service to infringe others' rights or violate applicable law; upload malicious code; or resell or commercially exploit the Service without our written consent.
The Service interoperates with third-party hardware (e.g., Garmin/Tacx and Wahoo trainers) and services (e.g., Strava, Spotify, Apple Music, Apple Health, Health Connect, Mapbox for maps and address search, and Google services for notifications, analytics, and advertising, including on the dashboard). Your use of those products is governed by their own terms and privacy policies. We are not responsible for third-party products, their availability, or changes to their interfaces that affect Service features. Connecting a third-party account authorizes us to exchange data with it as described in our Privacy Policy; you can disconnect at any time in the app.
App store terms. These Terms are between you and Kardiacs only — not with Apple Inc. or Google LLC. Apple and Google have no obligation to provide maintenance or support for the app and are not responsible for addressing any claims relating to it, including product-liability claims, legal-compliance claims, or intellectual-property claims. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the iOS app and may enforce them against you.
Some features generate suggestions using artificial intelligence — for example, playlist recommendations, in-session music mixes, and daily readiness narratives. Depending on the feature and your settings, this runs on your device (Apple Intelligence) or through our cloud AI provider, as described in the Privacy Policy. Suggestions are provided as-is, may be inaccurate or unsuitable, and are not professional, medical, or fitness advice. AI availability may depend on your device model, operating-system version, and settings. Use your own judgment.
The Service, including its software, design, built-in workout library, and branding, is owned by Kardiacs LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on devices you own or control. Except as this license expressly allows or the law permits, you may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of the Service or any part of it, or remove or alter any proprietary notices. All rights not expressly granted to you are reserved by Kardiacs and its licensors. Third-party trademarks (Garmin, Tacx, Wahoo, Zwift, Strava, Spotify, Mapbox, Google, Apple, and others) belong to their respective owners; their use does not imply endorsement.
Feedback. If you send us suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, royalty-free right to use it for any purpose without restriction or compensation to you.
Open source. The app includes open-source software components licensed under their own terms; those terms govern your use of the corresponding components, and a list of components and licenses is available on request at legal@kardiacs.com.
Copyright complaints. We respond to notices of alleged copyright infringement that comply with applicable law (including the U.S. Digital Millennium Copyright Act). Send notices identifying the copyrighted work, the allegedly infringing material, and your contact information to legal@kardiacs.com. We may remove content alleged to be infringing and may terminate the accounts of repeat infringers.
Map and routing data in the Service is derived in part from OpenStreetMap (© OpenStreetMap contributors, available under the Open Database License) and from the Overture Maps Foundation. Map rendering is provided by Mapbox under its own terms.
You may stop using the Service at any time, and delete your account — or, without an account, everything stored for your anonymous identity — in the app or by contacting us. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service; where practicable we will give you reasonable notice and an opportunity to export your data. Sections that by their nature should survive termination (including Sections 3, 4, 6, and 12–15) survive.
Inactivity. If you do not use the Service for 59 consecutive days, we permanently delete all data stored for your identity — anonymous or account — as described in Section 6 of our Privacy Policy. Any use of the app that reaches our servers resets this period. You are responsible for exporting anything you want to keep; deleted data cannot be recovered.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or compatible with your specific trainer hardware, phone model, or operating-system version. Bluetooth connectivity depends on your devices and environment.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARDIACS LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR USE, BUSINESS INTERRUPTION, COST OF SUBSTITUTE SERVICES, PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE SERVICE OR CONNECTED EQUIPMENT, UNAUTHORIZED ACCESS TO YOUR DATA, OR THE CONDUCT OR CONTENT OF ANY THIRD PARTY OR OTHER USER — WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) US $50. THESE LIMITATIONS APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
The exclusions and limitations in this Section and in Section 11 form an essential basis of the bargain between you and Kardiacs; the Service would not be provided on these economic terms without them. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. To the extent permitted by applicable law, any claim relating to the Service must be brought within one (1) year after the events giving rise to it; this time limit does not apply to consumers where mandatory law provides a longer period.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, for fraud, or — for EU/UK consumers — your statutory consumer rights. If you are a consumer in the EU or UK, you benefit from the mandatory protections of the law of the country where you live, and these Terms do not reduce them.
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Kardiacs LLC and its officers, employees, and agents from claims, damages, and reasonable expenses (including attorneys' fees) brought by a third party arising out of your User Content, your violation of these Terms or of applicable law, or your misuse of the Service. This Section does not apply to the extent a claim results from our own breach, negligence, or willful misconduct, and does not limit any rights you have as a consumer under mandatory local law.
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in that state, and you consent to their jurisdiction. Before filing a claim, you agree to first contact us at legal@kardiacs.com and attempt in good faith to resolve the dispute informally for 30 days.
Class action waiver. To the maximum extent permitted by law, disputes must be brought on an individual basis only, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. This paragraph does not apply where prohibited by law. EU/UK consumers may instead bring proceedings in the courts of their country of residence and retain the right to use local dispute-resolution mechanisms.
We may update these Terms from time to time. For material changes we will notify you in the app or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance; if you do not agree, stop using the Service.
These Terms, together with the Privacy Policy, are the entire agreement between you and Kardiacs regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
